According to the Department of Motor Vehicles:

"Impaired driving BAC between 0.05% and 0.08%:
Fine: $100 to $500
Imprisonment: Up to six months."

If you are convicted of a DUI with a BAC of more than 0.08%, the penalties are as follows:

First Offense:

  • Misdemeanor charge
  • Jail time of 10 days to one year
  • Fine up to $1,000

Second Felony Offense:

  • Felony charge
  • Jail time of one to seven years
  • Fine up to $5,000

Second Offense in Ten Years:

  • Felony charge
  • Jail time of one to five years
  • Fine up to $2,500

Third Offense (and Subsequent Offenses):

  • Felony charge
  • Jail time of one to 10 years
  • Fine up to $5,000
